Always research participating agents/editors before you sign up for one of these sessions; not all conferences do enough vetting. And think twice–or three times–before signing up for a pitch session that costs extra. These are not just moneymakers for the conference, but also, sometimes, for the agents, who get a cut (very similar to a reading fee). A submission service promises, for a fee, to approach publishers or agents on your behalf. Some simply send off your query and/or sample material; others offer editorial services to get your submission into shape, or create those materials for you. Sometimes part of the service is the “packaging” of your submission with a picture of you, a bio, a sample marketing plan, and the like. As a general rule of thumb, a new agent should begin making regular sales within a year of starting up. The one circumstance in which it’s OK for an agent not to have a track record is if s/he’s just starting out. A new agent who is actively building a client list can be a good prospect for a new writer. Be alert for unprofessional practice. How to tell a reputable agent’s website from a questionable one’s? They may run fee-charging publishers (possibly under different names, to conceal the connections), into which clients are funneled once they’ve racked up enough rejections to become desperate. They may refer writers to crooked critique services or pay-to-play publishers, receiving a kickback for their trouble. If more writers took the time to build a store of publishing knowledge before beginning the quest for an agent or a publisher–rather than trying to learn while they search–Writer Beware’s work would be much diminished. I hear every day from authors who’ve made mistakes they could easily have avoided if they’d only done their research ahead of time. Also, how much might running a publishing division distract from the agency’s core activity of representing manuscripts to publishers? Your agent is supposed to be your advocate in publishing contract negotiations–but who advocates for you when it’s your agent offering the publishing contract? Questionable agents, on the other hand, often derive much of their clientele from direct solicitation (here’s an example. from Writer Beware’s blog). If you subscribe to writers’ magazines or register your copyright, you may be a target–fee-charging agents often purchase lists of names and addresses from these sources. Overwhelmed? I don’t blame you. But in reality, it’s not difficult to tell a good agent from a bad one. The tips below will help. Go to a bookstore (yes, I know, very old school), and spend some time in the section where books on writing are shelved. There are many excellent how-to-get-published books that will help you learn the basics. Please don’t skip this step; it really is one of the best investments in your future career that you will ever make. Today, however, with the popularity of ebooks soaring and digital publishing easier and cheaper than ever before, these formerly clear-cut lines are blurring. Reputable agencies are increasingly branching out into publishing and self-publishing assistance. Reputable agents do sometimes contact writers whose work they’ve seen and liked. This used to be extremely rare, but blogs and social media have made it more common. However, it’s not the norm. Be wary of an agent who is looking for poets. Some agents–mostly questionable, but a few legitimate ones as well–justify domestic commissions (commissions on sales made in the agent’s home country) of 18% or 20% by claiming that it’s more costly to represent new writers. That may be so, but do you really want an agent who penalizes you for being new? There are also listings and directories that are much less helpful. Some have been created by individuals with little knowledge of publishing, bizarre personal agendas, or something to sell. Others are databases where anyone can enter unscreened information. They’re likely to include large numbers of questionable agents check my essay plagiarism, to omit large numbers of successful agents, and to be seriously out of date. Beware of “top” or “best” lists; even if they aren’t just clickbait, they’re bound to be subjective, since, due to experience or interest or temperament or any number of factors, the best agent for one writer might be the worst agent for another. However, publishers aren’t interested in fancy extras. Including these will identify your submission as coming from an unprofessional source. And submission services aren’t necessarily run by qualified people, and may not be skilled at writing queries or targeting appropriate editors and publishers (I’ve heard from many authors who’ve been contacted by vanity publishers after using submission services). This is especially true of the email query blast services. For the most part, submission services are a waste of money. For book agents, commissions should not be more than 10-15% for domestic sales and 20-30% for co-agented or foreign sales. Second, specific (i.e. verifiable) information on the agent’s work experience and background. Questionable agents don’t usually have relevant background, so their websites will not have a CV, or else will provide only vague, uncheckable claims. Some questionable agencies don’t even bother to name their staff. A growing number of marginal agents specialize in placing books with small presses that don’t require authors to be agented. Some of these agents have impressive numbers of such “sales” (I put “sales” in quotes because most small presses don’t pay advances). There’s nothing wrong with placing books with solid small presses–but the real test of an agent’s skill is getting in where an author can’t, i.e. to agented-only publishers. Why pay an agent 15% of your income for a book you could have placed yourself? Alternatively, the agent or agency may own the editing service or publisher, running it under under another name or at another address in order to conceal the connection. Some agencies are no more than fronts for editing or fee-based publishing businesses. The WGA’s Minimum Basic Agreement (a collective bargaining agreement that sets the terms under which WGA writers work with studios, agencies, and others) requires that agents charge a commission of not more than 10%. There’s nothing to compel agents to comply with the MBA–but major studios don’t generally deal with agents who don’t. A new agent (in business less than a year) should have a relevant professional background. Writer Beware defines a fee as any charge–excluding commissions–that’s a requirement for either submission or representation, that must be paid by every client or potential client, and that is due upfront (i.e. before service is rendered). For instance, a reading or evaluation fee the accompanies submission, a critique fee as a condition of representation, a retainer or representation fee due on contract signing, a submission or materials fee billed in advance of expenditure or on a recurring basis. Be wary of an agent who provides extravagant praise or inflated promises, and of her opposite, an agent who paints a dismal picture of your chances of success. Amateur agents may be genuinely well-intentioned. Many make a good-faith effort to place their clients’ work. However, their low skill level makes it unlikely that they’ll sell anything–or if they do, that they’ll ever manage to move beyond marginal status. Their poor sales records are a major incentive to charge fees in order to keep their businesses afloat, and they may have peculiar or nonstandard business practices (for instance, using clients’ own query letters). Amateur agents are also likely to place their clients with questionable publishers–not just because they don’t know better, but because these are often the only publishers that are willing to deal with them. The USA, UK, Australia, and New Zealand all have professional agents’ trade organizations (for the organizations’ websites, see the Links section, below), most of which require members to adhere to codes of ethics that help to ensure fair practice. Just as important my life essay, members must demonstrate some degree of professional achievement before they’re allowed to join. Any of these will immediately identify a submission as coming from an unprofessional source. However, not all new agents are created equal. In order to target manuscripts appropriately and get attention from editors–not to mention identify salable properties and effectively negotiate contracts–an agent needs personal contacts and a thorough knowledge of the publishing industry, both of which are best acquired by actually working in publishing or training at another reputable agency. Someone coming to agenting from a non-publishing-related background is unlikely to have these skills, and may take a very long time to get up to speed–if indeed they ever do. Starting work on a new project will help you through those months of waiting. So try to narrow down your search so it’s as close as possible to the kind of novel you’ve written. Look inside the books you take off the shelves. Note down the title, author, and publisher or imprint in your notebook. Then look at the Author Notes or Acknowledgments section. You’re looking for a note where the author thanks his or her literary agent. Many authors do this. When you find it, note the agent’s name and agency. I used to think writers had short fingernails because they typed all the time. Hah! I finally figured it out…it’s the WAITING. Only include details about characterization and subplots insofar as they relate to the resolution of the main plot. If you get a response back asking to see the full manuscript, as opposed to a “partial” — usually the first three chapters and synopsis (also often called an “outline”), keep querying. The only exception to this is if the agent or editor asks for an “exclusive” on the work. That means you agree to send the manuscript only to that person exclusively for a given period of time. If an agent asks for an exclusive, 30 to 60 days is pretty typical. If the agent or editor doesn’t specify the duration of the exclusive, you should. You would say something to the effect of “(Title) is being submitted on an exclusive basis, and will remain exclusive for 60 days, until (date)” and put that into your cover letter accompanying the manuscript. Third paragraph: this paragraph should contain a summary of your credentials for writing the book. If you don’t have any, then don’t try to manufacture them — that looks really lame. Just leave them out. As I said above, a good agent won’t turn up their nose at a good query just because the writer doesn’t have a publishing history. We’ve already established that your manuscript has to be edited, polished, and proofread — totally ready to be seen by agents. There are two other things you’ll need to work on before you’re ready to actually submit to the agents on that list you’ve created — the synopsis, and the query letter. – The other two categories of “credentials” you can mention would be lifetime experience, and/or academic degrees – providing they relate to the subject of your book. And also: there are worse things that can happen to a manuscript than remaining unpublished. Learn to trust your “gut feeling” when examining an agent’s website. Look carefully at their list of credentials and their track record of sales. If your gut tells you there is something flakey going on, don’t submit to the agent until you have checked them out in every possible fashion. I know that will be an unpopular suggestion. I’ve seen writers who have been rejected two or three hundred times still querying the same manuscript…without ever twigging that the book itself is the problem. If your query letter is bringing you requests to read partials on your book, or even the full manuscript, but then all you receive back is silence…or a form rejection, there’s a good chance that the problem isn’t your query letter — it’s your book that needs work. Credentials fall into three categories: If you do this kind of searching in books in a couple of bookstores, chances are you’ll wind up with a list of agents or agencies. Next, it’s time to start checking and expanding your list. Go through Writers Market. the hardcopy book, or online at www.writersmarket.com. Jeff Herman’s Guide to Book Publishers, Editors, & Literary Agents is another helpful resource. Good online sources to use to cross-check for information are AgentQuery and Query Tracker. They’re free, and they do “vet” the agents they list. Be warned: many online listings don’t bother to check whether the agents are “real” or not. 5. Real agents don’t insist on all client interactions being electronic. Real agents have phone numbers, and real snail addresses in addition to email addresses. When you sign with a real agent, that agent will TALK to you on the PHONE. You won’t be deluged with a slew of boilerplate-looking emails that are so generic they could apply to anyone. Remember: a bad literary agent is worse than no literary agent. Bogus agents these days often CLAIM they don’t charge fees. And for some reason a lot of new writers don’t equate “paying for a critique” as paying an agent fee. But if it walks like a duck, quacks like a duck, and the writer has to haul out his or her checkbook…it’s a fee. Take it from me. “No” means NO. And that’s ALL it means. Don’t take it personally. – Best and foremost, writing credentials. Writing credentials mean you’ve sold your writing. That means you received money for the right to publish it. Cite the venue, giving the title of the article, short story, or book. If you didn’t receive any payment for the writing, chances are you shouldn’t mention it. Things like letters to the editor published in your local paper don’t count. A recipe in a parish cookbook doesn’t count. Self-published books–and even small press books, if the agent isn’t likely to have heard of the press–don’t count unless they sold really well (on the order of thousands of copies). Any vanity-published book definitely doesn’t count. If, at the end of the sixty days (plus 10 days, say, as a “cushion”) you haven’t heard anything back from the agent, it’s proper to drop them a polite email asking if they’ve had a chance to read the work. If you get no reply, then go back to querying, and chalk it up as a rejection. Agents/editors are usually quick to communicate with a writer when they’ve found a writer they want to represent. Waiting months and months on tenterhooks, without a word, figuring “no news is good news” usually means you’re kidding yourself. Go back to querying. Then if the agent or editor comes back at a later date with a positive response, you’ll be pleasantly surprised, not a raving lunatic. Unless you’ve majorly screwed up, and made a real nuisance out of yourself — and yes leadership case studies examples, this has indeed happened in real life, agents do tell horror stories — the agent who has just rejected you doesn’t know you from Adam or Eve. Write a nonfiction book you’ve always wanted to write. 1. Too long. A good query letter is brief, no more than one page. When I say “one page” I mean a few hundred words–not one page crammed from top to bottom with narrow margins. Publishing, and trying to get published, can be a frustrating endeavor. I think the waiting is probably the hardest thing. Compared to glaciers, an alarming number of publishers are quite leisurely in how fast they move to acquire books, publish them, and (especially) issue checks. Your language in writing a query letter is very important. It must be smooth, flowing, and persuasive, without telling the agent what to think, or engaging in hyperbole. That one-line description of the work is often a make-or-break. In the writing business we sometimes refer to the one-line description as “the elevator pitch.” This term comes from Hollywood, and is based on the idea that writers should be able to summarize their books in one arresting, unforgettable line that will capture the attention of a producer or agent – while taking no more time than would be required for an elevator ride. “And then Gandalf meets his fate, to the grief of all his companions” sounds dull and stuffy, whereas, “Gandalf faces the fiery Balrog alone, and magically smashes the stone bridge, thus buying Frodo and his companions time to escape at the cost of his life. And then make sure that statement is true. Agents are not enthusiastic about “one shot” writers. Try sending out queries in batches. Don’t send a query to every agent in an agency at the same time. That’s a no-no. If you send five or ten per week, then you can take a couple of weeks off to work on your next book. So…query your little hearts out, my friends, as long as you’ve targeted your book properly, and researched the agent or publisher. Remember, the time to do your research is BEFORE that query or submission goes out! However, there are two literary agencies that are on Writer Beware’s “questionable” list that are AAR members. We’ve gotten complaints about them, and it’s pretty clear to us that they’re making most of their money off their clients, rather than sales of the clients’ books. If they say “query only,” that’s all you send. If they say “query plus synopsis,” that’s what you do. And so forth. If they don’t say “query only” then you might want to include the first five pages of your manuscript in the package, on the grounds that agents are as curious as kittens, and might well peek at your first five pages and be impressed, even if query letter didn’t set them on fire. If you do send those first five pages, make sure they are terrific. No errors, no typos, an excellent “hook” within the first couple of pages, etc. What does this tell you? Well, first of all, it tells you that some agents just don’t bother to send rejections when they’re not interested, for whatever reason.
